1. Interpretation and Scope
This website is operated by Hillsong International Ltd atf Hillsong International t/a Hillsong Network (ABN 81 254 249 210) (“Hillsong Network”). Your use of this website and the membership to the Hillsong Network (Membership) from this website is subject to these terms and conditions.
1.1 Interpretation:
Whenever “We”, “Our”, “Us” or “Hillsong Network” is used in these Terms and Conditions it is referring to your relationship with and an obligation or right, with Hillsong International Ltd atf Hillsong International t/a Hillsong Network.
Whenever “You” is used in the Terms and Conditions it is referring to the direct recipient of the Membership materials for the purpose of Hillsong Leadership Network Membership.
“Associate Access” means a complimentary membership for volunteers, leaders, and staff of Churches for ongoing on-demand access to Online Resources for one (1) person.
“Copyright” means and refers to definitions and rights granted in the Copyright Act 1968 (Cth).
“Pastors Connect” means a membership for Senior Pastors for a single use license for personal portal access to receive, including but not limited to, ongoing on-demand access to the online resources for one (1) person, invitations to events and access to special offers.
“Online Resources” are the downloadable resources accessible via the Products via the Online Portal.
“Products” means both the Associate Membership and Pastors Connect.
1.2 Scope of Use: The product provided is intended to be utilised for Churches of like heart and spirit committed to championing the cause of the local church and help grow and develop the leadership skills of individuals who play a part in building and expanding the Church and its mandate. If it is found that the Membership provided is being utilised other than this purpose, such as commercial use, Hillsong Network reserves the right to terminate the license granted at any time subject to clause 11 (Termination).
2. License and Restrictions on use
2.1 License: In consideration of your payment of the price, Hillsong Network grants you a limited, non-exclusive and non-transferable license to use the Product in accordance with these terms and conditions.
Hillsong Network may update or make other changes to the Product from time to time and may provide them to you at its discretion.
2.2 Restrictions on use
You must:
(a) Only use the Product for the purpose of being a part of the Hillsong Leadership Network, and not for any other purpose;
(b) Not sell, rent, lease, assign, licence, sub-licence or otherwise transfer the Product to any third party in any form;
(c) Take all steps reasonably necessary to protect the Product from unauthorised use, copying or disclosure;
(d) Not modify, adapt, translate, create derivative works, distribute, or publish online, any part of the Product, unless expressly permitted by these terms and conditions;
(e) Not use the Product to develop any other product or material having the same primary function of the Product; and
(f) Comply with all applicable laws, industry standards and codes when using the Product, including the Copyright Act 1968 (Cth).
3. Purchase of Products
3.1 The Product benefits will include the Online Resources as well as the benefits which you apply for and which are granted by Hillsong Network for the duration your access is active and payment details, where relevant are up to date, subject to the following terms and conditions.
3.2 All prices clearly indicate the currency you will be charged and are inclusive of relevant taxes where applicable.
3.3 You must pay for the Products you purchase on this website at the time of placing your order. Hillsong Network will issue a tax invoice to you when your payment has been successfully processed.
3.4 Unless otherwise agreed by Hillsong Network in writing, payment is by Amex, Visa or MasterCard only. Hillsong Network is not responsible for any bank fees that may be charged to you by third parties for the purchase of the Products. Your order and credit card details are safe and secure. All personal and credit card information provided to Hillsong Network is encoded using Secure Sockets Layer (SSL) technology, an encryption protocol that protects data as it travels over the Internet. We do not store credit card information on our servers.
3.5 Hillsong Network reserves the right to amend its pricing on the Website at any time, any new pricing structure will be effective from the renewal of the term for the Products.
4. Associate Access
4.1 Delivery
(a) Upon signing up to the Associate Access product, Hillsong Network will issue your access to the Online Resources and relevant membership benefits.
(b) Where a valid email address has been provided, Hillsong Network will confirm your access to the Product and subsequent Online Resources via email within 24 hours.
5. Pastors Connect
5.1 Application
(a) Hillsong Network will review and accept applications subject to applicants fulfilling the membership criteria and Hillsong’s ‘What We Believe’ Statement.
(b) Hillsong Network reserves the right to reject an application at its discretion.
5.2 Delivery
(a) If you are successful in your Pastors Connect application, Hillsong Network will issue your access to the Online Resources and membership benefits.
(b) Where a valid email address has been provided, Hillsong Network will confirm your membership purchase via email.
5.3 Term of Pastors Connect
(a) Access to Pastors Connect is subject to Hillsong Network’s approval.
(b) One (1) sub-account is available to be requested at the time the application is made.
(c) Upon Hillsong Network approving your application and payment of the membership fee Hillsong Network will provide access to Pastors Connect.
(d) Pastors Connect is a twelve-month program. Membership is calculated for a year from the date the membership application was accepted, and payment processed subject to the following terms and conditions.
(e) Your Pastors Connect Membership will automatically renew for a further 12 months upon expiry of the initial term, unless cancelled on or before the end of the membership term.
(f) Pastors Connect Membership can be cancelled after the first 12 months upon written notice to Hillsong Network at [email protected] fourteen (14) days prior to the next payment date. Cancellations after the first 12 months are able to be refunded which will be processed and calculated at a pro-rata’d rate.
(g) If your Pastors Connect Membership is cancelled your membership will be downgraded to the complimentary Associate Access.
(h) Once the initial 12-month membership term has expired Hillsong Network reserves the right to change the price and/or currency of the program. You will be given thirty (30) days’ notice and the opportunity to discontinue or renew at the new price and/or currency.
(i) Purchases of the Pastors Connect Membership are refundable within the first thirty (30) days of purchase. After the first thirty (30) days until the end of the initial membership term the membership fee is not refundable.
5.4 Hillsong Events
(a) Events organised are only able to be attended by the designated member of the Pastors Connect Membership and one (1) guest. If in the event you are unable to attend a live event you may request your ticket be reassigned to another member from within your Church. If you would like to reassign your ticket, please contact Hillsong Network prior to registering for the event.
(b) All live Hillsong Network events are recorded. Images of people attending or participating in these activities may be used in our TV ministry, resources, and for other ministry or promotional purposes. By attending Live Events hosted by Hillsong or Hillsong Network you agree that we may use your image. If this term is unable to be fulfilled by you, please contact [email protected].
(c) Hillsong Network recommends that you confirm your registration with our office prior to booking any flights or accommodation. Hillsong Network does not accept responsibility for losses incurred for flights or accommodation booked for Live Events. The organisers of Hillsong and Hillsong Network events reserve the right to change any of the published event details and have the final determination on any matter relating to the event. In the event Live Events of either Hillsong or Hillsong Network are changed, Hillsong Network will endeavour to notify you within a reasonable time of such changes.
6. Member Code of Conduct
6.1 Whilst Hillsong Network encourages and facilitates environments for members to gather at events, Hillsong Network and Hillsong Church events are a strictly ‘No Pitch’ environment.
6.2 Hillsong Network has a zero-tolerance for members who act in any way deemed to be offensive or inappropriate, including but not limited to the grounds of race, religion, or gender.
6.3 Members are expected to uphold this Code of Conduct at all times in all forums including Hillsong Network and Hillsong Church Events and social media. Members who breach the code of conduct may have their membership cancelled without refund.
7. Delivery
7.1 Once an application has been accepted, all aspects of the delivery, currency and payment arrangements are finalized and cannot be changed. Please check order details carefully prior to confirmation.
7.2 Please check your email address carefully before submitting your order. If your details are incorrect, Hillsong Network will not be responsible for not fulfilling your order.
7.3 Hillsong Network may accept or reject the purchase of a Membership at its discretion, including (without limitation) if the payment method appears fraudulent, or there is an error in the price or description of the Product. If Hillsong Network rejects your order, we will endeavour to notify you of that rejection.
7.4 The Membership will be accessible through the Hillsong Network portal online with the email address provided by you to Hillsong Network.
8. Intellectual Property Rights
8.1 Ownership: You acknowledge that all intellectual property rights in and to the Product is owned by, or licensed to, Hillsong Network. Except as otherwise expressly permitted by these terms and conditions, nothing in these terms and conditions transfers ownership in the product other than the expressly contained in these terms and conditions.
8.2 Copyright notice: You must ensure that all copies of the Product printed, published, made or reproduced subject to these terms and conditions, include the copyright notice “© 2020 Hillsong International Ltd atf Hillsong International” and any other proprietary notices as directed by Hillsong Network from time to time.
You must not remove, modify or obscure any copyright notice or other proprietary notices on the Product.
8.3 Copyright Infringements: All content provided by Hillsong Network is protected under the Copyright Act 1968 (Cth). If it is found that you or a beneficiary of your license has used our content in an unauthorised manner, Hillsong Network reserves the right to pursue any intellectual property or damages claim.
8.4 Hillsong’s Trademarks: Users with a Pastors Connect Membership may use Hillsong’s trademark to reference that you are part of the Hillsong Leadership Network. In no way does this grant you a license nor permission to refer to any closer association with Hillsong nor the use of the trade mark in any other way included but not limited to books, music, merchandise and any other goods or services.
9. Privacy
Hillsong Network is committed to protecting your privacy. Hillsong Network will comply with Hillsong International Ltd atf Hillsong International’s Privacy Statement and the Privacy Act 1988 (Cth). Hillsong Network will not reveal your personal information to external organizations except for the purposes of fulfilling your order or otherwise permitted or required by law. 10. Limitation of Liability
10.1 To the maximum extent permitted by law:
(a) The Product is provided ‘as is’ and Hillsong Network makes no warranties, representations, statements or guarantees in relation to this website or the Product, except those provided by law.
(b) Hillsong Network excludes all liability for any loss, liability, damage or expense (whether direct or indirect) which may be suffered by you or any third party, arising from or in connection with your access and use of this website and any Product you purchase through this website except for any negligent acts or omissions on behalf of Hillsong Network.
10.2 To the extent Hillsong Network’s liability cannot lawfully be excluded, our liability will be limited, at its option, to the resupply, repair or replacement of the Product or the cost of such resupply, repair or replacement.
11. Termination
Hillsong Network may terminate access to the Product granted under clause 2 at any time if you fail to comply with any of these terms and conditions.
Termination does not affect any accrued rights or remedies a party may have up to the date of termination.
Clauses 8 (Intellectual Property Rights), 10 (Limitation of liability), 11 (Termination) and 12 (General) survive termination.
12. General
12.1 Governing law: These terms and conditions are governed by the laws of New South Wales, Australia.
12.2 Entire Agreement: These terms and conditions constitute the entire agreement between the parties relating to its subject matter.
12.3 Variation: We may amend or update these terms and conditions without notice to you from time to time. If we amend or update these terms and conditions, we will take such steps as are reasonable in the circumstances to bring this to your attention, however, your continuing and ongoing use of this website will indicate your agreement to the amended or updated terms and conditions.
12.4 Force Majeure: Hillsong Network will not be liable for any delay or failure to perform its obligations under these terms and conditions due to events beyond its reasonable control.
(a) COVID-19: Hillsong Network will not be liable for any delay or failure to perform its obligations under these terms and conditions due to events beyond its reasonable control including but not limited to government health orders, travel restrictions and gathering restrictions.
12.5 Severability: If any clause (or part of any clause) in these terms and conditions is held by a court to be illegal, void or unenforceable, that clause (or part of a clause) is to be regarded as having been deleted from these terms and conditions, and these terms and conditions otherwise remain in full force and effect.
12.6 Educational Material: The Products provided is intended for education purposes. The Products do not constitute legal, business or financial advice and are not intended to be a substitute for legal, business or financial advice and should not be relied upon as such. You should seek professional in relation to any matters you or your Church may have.
12.7 No Guarantee: You acknowledge and agree that no representations or warranties are made with respect to the results to be obtained from purchasing the Products or their effectiveness to your Church’s specific needs.
By using Hillsong Networks services and by agreeing to these Terms of Use you agree to bound by these terms and conditions.
